Regulatory Alert: ATM Fee Disclosure and Nebraska State Law

On December 20, 2012, President Obama signed the ATM Fee Disclosure bill (H.R. 4367) into law. This law eliminated the federal requirement for posting a physical notice on the ATM notifying consumers of the potential imposition of fees for use of the machine. The federal law maintains the on-the-screen notice requirement.

Despite this law changing the federal requirements, it has no impact on Nebraska’s state law requirements. Under Nebraska Statute, Section 8-151.01 when the credit union imposes a surcharge for the use of its ATM, the credit union is required to  post a physical sign on the ATM machine and post a notice electronically during the course of the transaction that allows a customer to cancel the transaction without incurring a surcharge.

103rd Nebraska Legislature Begins

The 103rd Nebraska Legislature convened for its first day of a ninety-day session on January 9th.  The newly elected and re-elected State Senators were sworn in and the Legislature elected its leadership including Speaker of the Legislature.  Bill introduction will begin tomorrow and Senators have the first 10 days of the session to introduce legislation.

Call for League Director Nominations

The Nebraska Credit Union League is seeking nominations for three positions on the League Board of Directors.

Positions up for election are:

To become an eligible candidate, an individual must be a senior management employee (as defined by NCUA) or voting member of the board of the nominating credit union.  The nomination must be in writing and must be seconded in writing by one other credit union of the same Asset Category or Geographic District.

CFPB Issues Ability-to-Repay Rule, Proposed Amendments

Earlier this month, the CFPB issued its new “ability-to-repay” mortgage rule, which will take effect Jan. 10, 2014. The rule includes the following key elements: ability-to-repay determinations; presumption for qualified mortgages; general requirements for qualified mortgages; rural balloon-payment qualified mortgages; and additional Dodd-Frank Act provisions.
